GENERAL TERMS of URBAN PASSIVE


The present general terms and conditions are intended for Users (Customers) who use the services of the online store of URBAN PASSIVE (seller).

The use of the online store means that the User has familiarized themselves with these General Terms and agrees to comply with them.

General Terms of Use for the Website

The user agrees to use the online store in good faith and in accordance with the applicable legislation. The use of the site for illegal activities, abuses, or actions that may disrupt the normal functioning of the online store is prohibited.

Copyright

All informational resources and materials (texts and images) published in the online store and on the company's website are intellectual property and are protected by copyright. They are subject to protection under the current Copyright and Related Rights Act. Copying, distributing, modifying, or publicly using the content without the explicit permission of URBAN PASSIVE constitutes a violation of the law and carries civil, administrative, and criminal liability in accordance with the applicable Bulgarian legislation.

Data Protection

URBAN PASSIVE processes personal data of Users in accordance with applicable legislation and Regulation (EU) 2016/679 (GDPR). Personal data is collected solely for the purpose of processing orders, delivery, communication with customers, and improving services.

Users have the right to access, correct, delete, restrict processing, object to, and portability of their data.

The data is stored for the period necessary to fulfill contractual and legal obligations.

Goods and services

In the online store, goods are offered according to their categories and varieties, as well as delivery and installation services related to the goods. The terms for the provision of services are described in the Delivery and Installation paragraphs. The information about the goods includes key features, images, prices, availability, and applicable VAT.

There may be differences in the colors of the images due to the color settings of the screen on different electronic devices, as well as minor discrepancies in the description that do not affect the quality and effectiveness of the products.

Limitation of Liability

URBAN PASSIVE is not responsible for temporary interruptions or technical malfunctions of the online store, as well as for any discrepancies in the information caused by technical errors.

Orders. Order acceptance

Orders are placed through the online store and are subject to confirmation by the Seller. An order is considered accepted when it is confirmed by the Merchant. Confirmations are made via an electronic message to the specified email or by a phone call to the customer's provided contact number. Orders that are subject to confirmation include those that have been prepaid by bank transfer as well as orders requested for cash on delivery through another courier company.

The sales contract is considered concluded from the moment the order is confirmed by the Merchant.

Payment methods

Payment for orders can be made through:

  1. Cash on delivery – payment is made to the courier upon delivery and is applicable to some products that are marked with this option.
  2. Bank transfer – payment by bank transfer is possible for all products from the online store. The amount is transferred to the account of Urban Passive, with the reference: order number.

Reason: order number

A copy of the payment order must be sent to the email specified in the contacts of the online store, referencing the ORDER NUMBER and DATE of the order. Confirmation of the order acceptance by the Merchant is made after receiving confirmation of the completed bank payment.

Deliveries. Delivery time

Deliveries of the ordered goods are made to the address specified by the customer within:

  • for items available in stock - up to 3 business days after order confirmation or pickup from the warehouse on the next business day.
  • For items made in colors and sizes according to customer specifications, the delivery time is subject to further negotiation between the two parties, the customer and the merchant.

The goods are delivered to an address specified by the customer, with the supplier responsible for unloading them on the ground floor and having no obligations for carrying them to other floors.

The user is required to inspect the goods upon delivery and to note any visible defects in the presence of the courier/provider.

If the address is incorrect or the User is absent, URBAN PASSIVE is not responsible for delays or inability to deliver.

Deliveries are made with courier companies: Econt, Speedy, other transport companies, or with vehicles owned by the company.

The delivery cost is determined based on the chosen courier and the volume of the order and is specified before finalizing the order.

Prices and promotions

  1. All prices are in euros (EUR) including VAT.
  2. URBAN PASSIVE reserves the right to change prices and availability without prior notice. Changed prices do not affect orders that have been accepted and confirmed by the merchant.
  3. Promotional offers cannot be combined with other discounts.

Claims and warranties

  1. The user may file a complaint within 7 days from the date of delivery for discrepancies between the goods and the description or for obvious defects.
  2. For this purpose, the User should contact +359 (0)884 044 603 or office@urbanpassive.bg.
  3. URBAN PASSIVE guarantees compliance of the goods with the sales contract within the legal deadlines.
  4. A commercial warranty may be provided by URBAN PASSIVE and is only valid if the conditions in the warranty card are met.

The present term does not limit the legal rights of the consumer under the Consumer Protection Act.

Cancellation of contract and return of goods

  1. Consumers can cancel their order within 14 days of receiving the goods, without providing a reason. (Except in cases of colors made to special customer order, which are not maintained as stock.)
  2. The returned goods must be in their original packaging, with all accessories and without damage.
  3. URBAN PASSIVE refunds the amount for returned goods via bank transfer within 14 days of receiving the goods back.
  4. Returns of personalized or custom-made goods are not accepted.

Cookie Policy

The site uses "cookies" to enhance the user experience, analyze traffic, and operate the online store. The user can control the use of cookies through their browser settings.

In the event of disputes, the User may contact the Consumer Protection Commission (CPC) and may also use the online dispute resolution (ODR) platform:

Entry into force and changes

The present General Terms and Conditions come into effect from the date of their publication on the website.
